By accessing or using ImgOptimizer ("the Service"), you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using the Service.

ImgOptimizer provides image optimization services that allow users to reduce the file size of their images while maintaining visual quality. The Service may include:

• Image compression and optimization
• Format conversion
• Batch processing
• API access for programmatic optimization
• Storage of optimized images (for paid plans)

Some features of the Service may require registration for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding the password that you use to access the Service and for any activities or actions under your password. We encourage you to use "strong" passwords (passwords that use a combination of upper and lowercase letters, numbers, and symbols) with your account.

Your Content: You retain all rights to the images you upload to the Service. By uploading images, you grant us a limited license to process, optimize, and store your images solely for the purpose of providing the Service to you.

Our Content: The Service and its original content, features, and functionality are owned by ImgOptimizer and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You agree not to use the Service:

• In any way that violates any applicable national or international law or regulation
• To transmit, or procure the sending of, any advertising or promotional material, including any "junk mail," "chain letter," "spam," or any other similar solicitation
• To upload, process, or distribute any content that is illegal, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable
• To impersonate or attempt to impersonate ImgOptimizer, an ImgOptimizer employee, another user, or any other person or entity
• To engage in any other conduct that restricts or inhibits anyone's use or enjoyment of the Service, or which may harm ImgOptimizer or users of the Service

Free Tier: We offer a free tier with limited features and usage caps. No payment information is required for the free tier.

Paid Subscriptions: For advanced features and higher usage limits, we offer paid subscription plans. By subscribing to a paid plan, you agree to pay the subscription fees as described at the time of purchase.

Billing: For paid subscriptions, you will be billed in advance on a recurring basis depending on your subscription plan (monthly or annually). Payment methods accepted include credit cards, debit cards, and other payment methods as specified on our website.

Cancellation: You can cancel your subscription at any time through your account settings. Upon cancellation, your subscription will remain active until the end of your current billing period.

In no event shall ImgOptimizer, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Service
• Any conduct or content of any third party on the Service
• Any content obtained from the Service
• Unauthorized access, use, or alteration of your transmissions or content

Your use of the Service is at your sole risk. The Service is provided on an "AS IS" and "AS AVAILABLE" basis. The Service is provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

These Terms shall be governed and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.
